1About the Service

PickThisTool.com is a directory and review platform for software tools and applications. We provide listings, comparisons, and user-submitted reviews to help visitors discover and evaluate tools. We do not manufacture, sell, host, or control the third-party tools and software listed on the Site, and we are not a party to any transaction between you and a third-party tool provider.

2Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction, if higher) to use the Site. By using the Site, you represent that you meet this requirement. If you are using the Site on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

3Accounts

3.1 To submit reviews, comments, or listings, you must register for an account.

3.2 You agree to provide accurate, current, and complete information during registration and to keep it updated.

3.3 You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at admin@pickthistool.com if you suspect unauthorized use of your account.

3.4 We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or are inactive for an extended period, at our reasonable discretion.

4User-Generated Content

4.1 Your Content. "User Content" means any reviews, ratings, comments, tool listings, or other material you submit to the Site.

4.2 License Grant. By submitting User Content, you grant PickThisTool.com a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, use, reproduce, modify, adapt, publish, translate, and display that content in connection with operating and promoting the Site, in any media now known or later developed.

4.3 Your Responsibility. You are solely responsible for your User Content. By submitting content, you represent that:

• You own it or have the necessary rights and permissions to submit it;
• It does not infringe any third party's intellectual property, privacy, or other rights;
• It is not false, defamatory, misleading, or fraudulent (e.g., fake reviews, undisclosed incentivized reviews presented as independent, or reviews for products you have not genuinely used);
• It does not contain malware, spam, unlawful content, or hate speech.

4.4 Moderation. We may, but are not obligated to, monitor, edit, refuse to post, or remove any User Content at our discretion, without notice, including content we reasonably believe violates these Terms or applicable law.

4.5 No Endorsement. User Content (including reviews and ratings) reflects the views of the individual submitter, not PickThisTool.com. We do not verify or guarantee the accuracy of user reviews.

5Third-Party Tools and Listings

5.1 The Site contains information about, links to, and descriptions of third-party software tools. This information is provided for general informational purposes and may be sourced from public information, the tool providers, or user submissions.

5.2 We do not guarantee the accuracy, completeness, availability, pricing, or performance of any third-party tool listed. You should independently verify details directly with the third-party provider before making decisions (including purchasing decisions) based on Site content.

5.3 Links to third-party websites are provided for convenience. We do not control and are not responsible for the content, privacy practices, or terms of any third-party site.

5.4 Affiliate Relationships. We may in the future participate in affiliate programs, meaning we may earn a commission on qualifying purchases made through links on the Site, at no additional cost to you. Where applicable, this will be disclosed in accordance with applicable advertising disclosure laws (e.g., FTC guidelines, ASA/CMA guidance, or equivalent regulations in your jurisdiction).

6Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Post false, misleading, defamatory, or fraudulent reviews (including reviews for tools you have not used, or reviews submitted in exchange for undisclosed compensation);
• Scrape, crawl, or harvest data from the Site using automated means without our prior written consent;
• Attempt to gain unauthorized access to any part of the Site, other accounts, or related systems;
• Introduce viruses, malware, or other harmful code;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Interfere with or disrupt the Site's functioning or servers.

We reserve the right to suspend or terminate access for any user who violates this section.

7Intellectual Property

7.1 All Site design, text, graphics, logos, and software (excluding User Content and third-party trademarks/logos used to identify listed tools) are owned by PickThisTool.com or its licensors and protected by intellectual property laws.

7.2 Trademarks, logos, and brand names of third-party tools listed on the Site belong to their respective owners and are used for identification and comparison purposes only. Their inclusion does not imply endorsement, partnership, or sponsorship unless explicitly stated.

7.3 You may not copy, reproduce, distribute, or create derivative works from the Site's content without our prior written permission, except for personal, non-commercial use.

9Limitation of Liability

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10Indemnification

You agree to indemnify and hold harmless PickThisTool.com, its owners, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your User Content, your violation of these Terms, or your violation of any law or third-party right.

11International Use and Compliance

11.1 The Site is intended for a global audience. We make no representation that the Site is appropriate or available for use in every location. If you access the Site from outside your home country, you do so at your own initiative and are responsible for compliance with local laws.

11.2 For users in the European Economic Area and United Kingdom: Nothing in these Terms limits any statutory rights you have under the GDPR/UK GDPR or applicable consumer protection law that cannot be waived by agreement.

11.3 For users in California and other U.S. states: Nothing in these Terms limits rights under applicable state privacy laws (e.g., CCPA/CPRA) that cannot be waived by agreement.

12Termination

We may suspend or terminate your access to the Site at any time, with or without cause or notice, including for violation of these Terms. Sections that by their nature should survive termination (e.g., Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law) will survive.

13Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date will reflect the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify registered users (e.g., via email or Site notice).

14Governing Law and Dispute Resolution

14.1 These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law principles, except where mandatory local consumer protection laws of your country of residence provide otherwise.

14.2 Informal Resolution First. Before filing any claim, you agree to first contact us at admin@pickthistool.com to attempt to resolve the dispute informally within 30 days.

14.3 Arbitration. Any dispute not resolved informally shall be referred to and finally resolved by arbitration administered under the Rules of Arbitration of the International Chamber of Commerce (ICC), with the seat of arbitration in Singapore, conducted in the English language. Singapore is used as a neutral venue given PickThisTool.com's international user base.

14.4 Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction for infringement of intellectual property rights or unauthorized access to the Site.

15Miscellaneous

15.1 Entire Agreement. These Terms, together with our Privacy Policy and User Agreement, constitute the entire agreement between you and PickThisTool.com regarding the Site.

15.2 Severability. If any provision is found unenforceable, the remaining provisions remain in full effect.

15.3 No Waiver. Our failure to enforce any right or provision is not a waiver of that right.

15.4 Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
